4. Client Obligations

4.1 By using our services, you agree to provide accurate and complete information as requested, whether this is through enquiries, online or telephone bookings, paid or free service registrations, payment plans, account set up and logins or any other alternative forms of communication with and through MPH Evolutions, such as social media platforms, that requires your full name, email address and any other contact information including your payment details (where applicable).
4.2 You agree to comply with all applicable laws and regulations regarding your use of our services, as governed by the jurisdiction of the Government of England and Wales.
4.3 You are responsible for maintaining the confidentiality of any login information, accurate and up to date payment information and personal information associated with your account, also outlined further in section 14 Data Security.
4.4 You agree not to share any access nor distribute to your account, login details or products, programs, classes or courses and any of its materials in any format, including but not limited to audio downloads, video content, PDF content or other materials, and maintain complete confidentiality throughout.

4.4.1 Hypnotherapy Disclaimer and Confidentiality

Within Hypnotherapy sessions, you are entitled to the same privacy and confidentiality regulations as with any other medical professional, counsellor, or mental health therapist. Your safety and well-being are my utmost priority. When using any self-help audio downloads related to hypnosis, it is therefore your own obligation to follow the safety instructions provided within the recordings to prevent any potential injuries and to ensure your safety and well-being.

4.4.2 Limitations and Precautions

“Please note that there are some limitations regarding psychological and medical health issues to consider when seeking therapy through hypnosis. If you suffer from seizures, epilepsy, brain injuries, or have a diagnosis related to BPD or severe mental health conditions, hypnosis is NOT recommended for you. ADHD or Autism is not categorised as a severe mental health condition.

If you have any other health condition(s) not listed in the area of specialization mentioned and are unsure if this treatment is suitable for you, you may book a free consultation call to discuss this. However, please also consult your medical professional for advice. If we receive or have any doubts, concerns, or misleading information that you provided regarding your health, MPH Evolutions reserves the right to cancel and deny any future treatment(s). In such cases only, any unused sessions will be refunded in full.”

4.4.3 Medical Confirmation Requirement

You may be asked to provide written confirmation from your medical professional for any hypnotherapy treatments, especially if you are on chemical medications. Even with all necessary precautions, MPH Evolutions waives any responsibility for the success or lack thereof of any outcomes and will not be held accountable for any damages or losses. By booking and paying for any treatments, you hereby agree to these terms.

4.4.4 Age Requirement and Accompaniment

Hypnotherapy is recommended for individuals aged 7 and over. Minors (age 7-16 years) must be accompanied by a trusted adult of their choice for any consultation and sessions. Any young adult may choose by their own free will to have a trusted adult with them for any consultations or sessions, however MPH Evolutions reserves the rights to suggest or request privacy of the client (young adult), if any continuous interference or disruption where the treatment of the young adult is compromised. This complies with UK law and regulations.

4.4.5 Rescheduling, Missed Appointments & Fines

“If you are unable to attend a pre-booked hypnotherapy session, you agree to notify MPH Evolutions in writing (text, email or direct messaging) at least 24 hours (one day) before your appointment time to reschedule.

Missed, cancelled, or rescheduled appointments made less than 24 hours prior to the appointment time will incur an administrative fee of £50.00 (GBP), or the client may request a refund. However, due to this inconvenience, MPH Evolutions reserves the right to deduct 50% of the total bookable value for the client’s refund.

Missed appointments or sessions for individual personal coaching (121 coaching) may not be rescheduled (depending on availability), unless MPH Evolutions was notified by the client at least 12 hours beforehand via phone call, as well as sending a written confirmation by email or direct message to the Mobile contact of MPH Evolutions.

For missed appointments or sessions within group coaching, clients will have access to video/audio replays within their private group community.”

5. Payment Terms & Refunds Policy

5.1 Any Payment is due upon registration or as otherwise specified for each specific service or product and it is considered the clients obligation to ensure any payments are made “on time” as outlined in any payment plans or extended credit agreements provided by us, prior to receiving any of our services.
5.2 All fees, including credit set-up fees, late payment or missed appointment fees and others, are non-refundable and non-negotiable. Claiming otherwise “special circumstances” in order to change any pre-existing payments or payment plans to a different payment plan must be filed as such a request in writing, and will only be considered one time (once), when received in writing, however a favourable outcome for the client cannot be guaranteed.

5.3 Refund Requests

5.3.1IF YOU DO NOT AGREE TO THESE SET OUT TERMS AND CONDITIONS, YOU MUST NOT USE ANY OF OUR SERVICES and you have the statutory right to cancel any purchases, products*, services, programs, classes, and courses or a paid subscription within 14 days of purchase – PRIOR to entering into or creating your login account to access any course materials, video content, replays, PDF’s and downloads, PROVIDED that these purchases, products, services, programs, classes, and courses, and all associated materials HAVE NOT BEEN STARTED, USED OR ENGAGED WITH. MPH Evolutions reserves all rights to refuse any refund requests where there is reasonable doubt. Only written requests will be considered for a full refund. *All instant downloads are excluded from the statutory rights and are therefore are non-refundable. If we receive information or have any reasonable doubts, concerns, or uncover misleading information that you’ve provided regarding your health or otherwise that could deem as fraudulent, MPH Evolutions reserves the right to cancel any agreements and deny any future treatment(s) and may involve local law enforcement where applicable or necessary. In such cases only, any unused sessions will be refunded in full depending on the resulting circumstances.
5.3.2 Upon approval of your refund and/or termination of any previous agreement by the Owner (MPH Evolutions), your access to any purchases, products, services, programs, classes, and courses, along with all its associated materials, will be revoked immediately. This includes any access to social platforms and groups, and you will receive any refunds in due course or as soon as the owner’s bank has processed the refund transaction. Please note that digital purchases, such as instant audio downloads or PDF files, are always excluded from your statutory rights and are therefore non-refundable.

5.4 Refused Refunds & Disputes

5.4.1 Where there is undeniable evidence presented by the owner (MPH Evolutions) to the purchaser that a cancellation/refund request has been denied, and it is evident that such activity has been made by the purchaser and said purchases, products, services, programs, classes, and courses, along with any of its materials, have been accessed, explored, and/or downloaded by the purchaser, MPH Evolutions reserves all rights to refuse any refund, whether this was requested in full or as a partial refund. All future payments, as applicable within each payment plan, will therefore constitute a legally binding contract between the purchaser, the purchaser’s bank or building society with MPH Evolutions, to fulfil such duty until the arranged payment period has ceased as outlined in their subsequent payment plan breakdown. Please note, if any evidence of this legal agreement has to be provided to the purchaser’s bank in order to obtain any future payments ‘forcefully’, this will heavily impact your credit scoring negatively.

5.5 Unauthorised Payment Cancellation

5.5.1 Any active cancellation or wilful termination of payment cards (charge-backs) or cancellation/unfulfilled direct debits via the purchaser’s bank or building society’s account for recurring payments related to programs, services, classes, or courses will result in legal action if no alternative payment method is reinstated upon the request of MPH Evolutions. The purchaser will receive a written notification via email, using the registered details, on the same day as the failed payment occurrence, reminding of the legally binding agreement with MPH Evolutions. The purchaser will have a maximum of 48 hours (two days) to reinstate an alternative payment method before further actions are taken. Access to programs, classes, courses, sessions and their materials will be immediately blocked until payment details are reinstated, and any overdue amounts are recovered by MPH Evolutions.

5.6 Failed Payments

5.6.1 If a failed payment (or ‘bounced’ payment) occurs i.e. due to changes in financial conditions or lack of funding, it is the purchaser’s responsibility to immediately contact MPH Evolutions in writing or arrange a Zoom Discovery call to discuss and reinstate any owed payments within the agreed time frame. A “special case” situation will be considered only once within the initially agreed contract period, and all rights are reserved by the owner to refuse such an option where appropriate. If a newly agreed recurring payment agreement is breached again anytime thereafter and the purchaser fails to reinstate the direct debit or another form of recurring payment to fulfil their previous obligations, legal proceedings and/or forceful actions involving your bank will be pursued to retrieve any owed amounts to MPH Evolutions.
5.6.2 Repeatedly late payments may incur interest at the rate of 8% per month as set by the Late Payment of Commercial Debts (Interest) Act 1998.

6. Intellectual Property

6.1 All materials provided as part of our services, including but not limited to course materials, programs, and products, are the exclusive intellectual property of MPH Evolutions and are protected by copyright laws.
6.2 You are granted a limited, revocable, non-transferable license to access and use the materials solely for your personal educational purposes within the scope of the specific program or course in which you are enrolled. This license does not permit you to reproduce, distribute, or create derivative works from our materials without our prior written consent.
6.3 You may not use our materials for any commercial purposes, whether for personal gain, monetary aspects, or non-profit activities, without obtaining our express written permission.
6.4 Any use of our materials beyond the scope of the specific program or course, including but not limited to sharing, copying, or distributing them to others, is strictly prohibited unless authorised in writing by MPH Evolutions.
6.5 You may use the tools and skills learned within the “Reviving Freedom Program” within your own personal and immediate family settings, such as aiding your own children with their transformational learnings. However, any replication or dissemination of the program content beyond these boundaries requires explicit written consent from MPH Evolutions.
6.6 Any unauthorised use or reproduction of our intellectual property will result in legal action to protect our rights and seek appropriate remedies.

7. Limitation of Liability

7.1 The Limitation of Liability section aims to define the extent of our legal responsibility for any damages that may arise from the use of our services. It states that to the fullest extent permitted by law, we will not be held liable for any direct, indirect, incidental, special, or consequential damages or losses that may result from the use or inability to use our services.
7.2 Direct damages refer to losses that directly result from our actions or omissions, such as financial losses or property damage directly caused by our services. Indirect damages are those that result from unforeseeable consequences of using our services, such as lost profits or business opportunities.
7.3 Incidental damages are minor losses or inconveniences that occur as a result of using our services, while special damages are losses that are specific to the individual circumstances of the user. Consequential damages are those that result from indirect or secondary effects of using our services, such as repetitional damage or loss of goodwill.
7.4 It’s important to note that this limitation of liability clause is intended to protect us from legal claims for damages that are beyond our control or unforeseeable. However, it does not absolve us of liability for damages resulting from our own negligence, fraud, or intentional misconduct.
7.5 Users should be aware that the extent of our liability may vary depending on applicable laws and regulations in their jurisdiction. Therefore, it’s advisable to review this section carefully and seek legal advice if necessary to understand their rights and remedies in case of any disputes or claims arising from the use of our services.
7.6 By agreeing to these terms and conditions, users acknowledge and accept the limitations of our liability as outlined in this section.

8.3 The parties hereby agree to submit to the jurisdiction of the courts of England and Wales for the purpose of resolving any such dispute.

9. Online Video Consultations and Coaching Sessions

9.1 By participating in online video consultations, coaching and therapy sessions offered by MPH Evolutions, you consent to the recording of these sessions for the purpose of compliance with insurance policies and for potential future use in programs, courses, demonstrations, testimonials, and advertising on social media (where appropriate).
9.2 Recordings may be conducted using video conferencing platforms such as Zoom or other social media platforms, as deemed appropriate by MPH Evolutions.
9.3 The recordings may be used for the following purposes:
– Compliance with insurance policies and regulations
– Public disclosure within future programs, courses, or demonstrations, with consent of the client.
– Creation of testimonials and advertising materials for promotional purposes on social media and other marketing channels, with consent of the client.
9.4 MPH Evolutions will take reasonable measures to ensure the security and confidentiality of recorded sessions. Access to recordings will be restricted to authorised personnel only, and recordings will be stored in accordance with applicable data protection laws and regulations. Please also refer to section 14 Data Security and section 15 GDPR Compliance.
9.5 By participating in online video consultations and coaching sessions, you acknowledge that recordings may contain personal information and agree to the collection, processing, and storage of your personal data as described in our Privacy Policy.
9.6 If you do not wish to have your sessions recorded or used for public disclosure and promotional purposes, please inform your coach or consultant in advance, and alternative arrangements may be made at the discretion of MPH Evolutions.
9.7 MPH Evolutions reserves the right to review and analyse recorded sessions for the purpose of improving the quality and effectiveness of our services. However, recordings will not be shared with third parties without your consent, except as required by law or as necessary to comply with insurance policies.
9.8 By participating in online video consultations, coaching and therapy sessions, you consent to the recording of these sessions and potential future use as outlined in this section.

10. Dispute Resolution

10.1 The Dispute Resolution section outlines the process for resolving any disputes that may arise between us and our users in connection with these terms and conditions.
10.2 By specifying the exclusive jurisdiction of the courts of England and Wales (United Kingdom), we establish the legal framework within which any disputes will be resolved. This means that any legal proceedings related to these terms and conditions must be brought before the courts of England and Wales.
10.3 The exclusive jurisdiction clause provides clarity and predictability for both parties regarding the venue for resolving disputes. It helps to avoid jurisdictional disputes and streamlines the legal process by ensuring that all legal matters are heard in a single jurisdiction.
10.4 It’s important to note that by agreeing to these terms and conditions, users consent to the exclusive jurisdiction of the courts of England and Wales for resolving any disputes. This means that users may be required to litigate any disputes in England and Wales, even if they are located outside of these jurisdictions.
10.5 While this section specifies the exclusive jurisdiction of the courts of England and Wales, alternative dispute resolution mechanisms, such as mediation or arbitration, may also be considered to resolve disputes in a more efficient and cost-effective manner. However, any such alternative dispute resolution mechanisms would need to be agreed upon by both parties.
10.6 It’s advisable for users to carefully review this section and understand the implications of agreeing to the exclusive jurisdiction of the courts of England and Wales before accepting these terms and conditions.
10.7 By agreeing to these terms and conditions, users acknowledge and accept the exclusive jurisdiction of the courts of England and Wales for resolving any disputes arising from or in connection with these terms and conditions.

11. Amendments

11.1 The Amendments section outlines our right to make changes or modifications to these terms and conditions at any time.
11.2 As a business, we reserve the right to update or amend these terms and conditions to reflect changes in our services, legal requirements, industry standards, or other relevant factors. This flexibility allows us to adapt to evolving circumstances and improve the clarity and effectiveness of our terms and conditions.
11.3 Any amendments made to these terms and conditions will be effective immediately upon posting on our website. This means that as soon as the changes are published on our website, they become legally binding and applicable to all users of our services.
11.4 It’s important to note that users have a responsibility to review these terms and conditions periodically for any changes or updates. By continuing to use our services after the posting of amendments, users indicate their acceptance of the revised terms and conditions.
11.5 We may provide notice of amendments through various means, such as posting a notice on our website, sending an email notification to users, or other appropriate communication channels. However, regardless of whether individual notice is provided, the amended terms and conditions will still be effective upon posting on our website.
11.6 It’s advisable for users to review these terms and conditions regularly to stay informed about any changes or updates that may affect their rights and obligations when using our services.
11.7 By including an Amendments clause, we ensure transparency and provide users with notice of any changes to these terms and conditions, while also asserting our authority to make amendments as necessary to reflect the evolving nature of our business and legal requirements.

12. Severability

12.1 If any provision of these terms and conditions is found to be invalid or unenforceable, such provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.
12.2 The Severability section addresses what happens if any provision of these terms and conditions is deemed invalid or unenforceable by a court of law.
12.3 If any provision of these terms and conditions is found to be invalid or unenforceable, it means that the provision cannot be upheld or enforced as written. This could occur if the provision conflicts with applicable laws or regulations, or if it is otherwise determined to be legally invalid for any reason.
12.4 However, the invalidity or unenforceability of one provision does not affect the validity or enforceability of the remaining provisions of these terms and conditions. The Severability clause ensures that the rest of the terms and conditions remain in full force and effect, despite the invalidity or unenforceability of any individual provision.
12.5 In other words, if one part of these terms and conditions is deemed unenforceable, the remaining provisions will still be valid and enforceable to the fullest extent permitted by law. This helps to preserve the overall enforceability and integrity of the agreement between the parties.
12.6 It’s important to include a Severability clause in these terms and conditions to provide clarity and certainty in the event of any legal challenges or disputes regarding the validity or enforceability of specific provisions.
12.7 By including a Severability clause, we demonstrate our intention to preserve the enforceability of these terms and conditions to the greatest extent possible, even if certain provisions are found to be invalid or unenforceable.
12.8 Users should be aware of the Severability clause and understand its implications for the interpretation and enforcement of these terms and conditions. If any provision is found to be invalid or unenforceable, the parties may need to negotiate or amend the agreement to address the issue while preserving the overall intent and purpose of the terms and conditions.

15.5 You have certain rights under GDPR, including the right to access, rectify, or erase your personal data, the right to restrict or object to its processing, and the right to data portability. For more information about your rights and how to exercise them, please refer to our Privacy Policy.

16.2 You are prohibited from using any part of these terms and conditions, including but not limited to clauses, provisions, or language, to create similar agreements or documents without obtaining prior authorisation from MPH Evolutions.
16.3 Any unauthorised copying, reproduction, or use of the details mentioned in these terms and conditions for the purpose of creating derivative works will be considered a violation of our intellectual property rights and may result in legal action.
